By downloading or using Enviya ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App. These Terms incorporate our Privacy Policy.

1. Eligibility

Enviya is intended for adults. You must be 18 years of age or older to use the App. By using Enviya you represent that you are 18 or older. Do not use the App on behalf of, or upload photos of, anyone under 18.

2. License

Moonsail Software LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control, subject to these Terms and the rules of the platform from which you downloaded the App (Google Play or the Apple App Store).

3. What Enviya Does

Enviya is an AI-assisted beauty-coaching tool. You upload a photo of a look you want and scan your own face, and the App generates a personalized, text-based hair, makeup, and skin plan describing techniques to work toward that look, along with a progress score you can re-scan over time. Your photos are analysis input only; the App does not render, generate, morph, or output any image of you or of the look you uploaded. See the Privacy Policy for how photos are handled.

4. Your Content and the Look You Upload

You are responsible for the photos you provide. By uploading a target look image, you represent and warrant that:

• You have the right to upload and use that image, and doing so does not violate any law or any third party's rights (including privacy, publicity, or intellectual-property rights).
• The image does not depict a minor.
• You authorize us to process the image solely to extract style attributes for your own personalized plan, as described in the Privacy Policy.

You agree not to upload unlawful, infringing, or harmful content. We do not claim ownership of your photos, and we do not retain the uploaded images beyond the request that analyzes them.

5. AI-Generated Content; No Professional Advice

Enviya's scores, attributes, and plans are generated by automated AI systems and are provided for general informational and entertainment purposes only. They are not professional medical, dermatological, cosmetic, or mental-health advice, and they are not a diagnosis or treatment. AI output can be inaccurate or incomplete. Results are not guaranteed, and individual outcomes vary. Some guidance describes techniques that create the appearance of a feature (for example, contouring) rather than permanent change. Always use your own judgment, patch-test products, follow product instructions, and consult a qualified professional before making decisions that could affect your health or skin. You use the App and rely on its output at your own discretion and risk.

If the App shows you AI-generated content you believe is inappropriate, you can report it using the in-app "Report this result" control.

6. Subscriptions and In-App Purchases

Enviya offers an optional auto-renewing subscription that unlocks the full result (sub-scores, your plan, progress tracking) and a metered allowance of fresh looks. Subscriptions are processed by Google Play (Android) or the Apple App Store (iOS) and are subject to their respective billing policies.

• The subscription is $3.99 per week. There is no free trial. You are charged immediately upon subscribing.
• The subscription auto-renews each week unless cancelled at least 24 hours before the end of the current period. Your payment method is charged for renewal within 24 hours before the period ends.
• The subscription provides a metered allowance of new "fresh look" analyses per period (not unlimited); re-scanning a look you have already analyzed does not count against the allowance.
• You can manage or cancel your subscription at any time through your platform's account settings (Google Play or the App Store). Deleting the App does not cancel a subscription.
• Prices may vary by region and may change; any change will apply only to future billing periods. Refunds are governed by Google Play's or Apple's refund policies. We do not process refunds directly.

7. Referral Program

Enviya may offer a referral program in which you can share your referral code. When the required number of newly referred users each complete a genuine scan, the referrer may receive a promotional credit that unlocks one full result.

• Referral credits are a free promotional benefit, have no cash value, are not a currency or stored value, and cannot be transferred, sold, or redeemed for money.
• Only the referrer is rewarded. A referred user receives nothing for installing or registering, and no reward is tied to rating, reviewing, or downloading any app.
• A referral credit unlocks one look, not standing access; continued access requires a subscription.
• We may modify, suspend, or end the referral program, and may withhold or revoke credits we reasonably believe were obtained through fraud, automation, or other abuse.

8. Acceptable Use

You agree not to:

• Upload content that is unlawful, infringing, or that depicts a minor, or that you do not have the right to upload.
• Attempt to circumvent, reverse-engineer, or tamper with the App, our backend, usage limits, the referral system, or any security measures.
• Use automation, bots, or fraudulent activity to abuse referrals, usage allowances, or free features.
• Use the App in any way that violates applicable laws or regulations or these Terms.

9. No Warranty

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or the accuracy or reliability of any AI-generated output. We do not warrant that the App will be error-free, uninterrupted, secure, or that any result will meet your expectations.

10. Limitation of Liability

To the fullest extent permitted by law, Moonsail Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including any reliance on AI-generated output, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of these Terms or your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be resolved in the courts located in Portland, Oregon.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the App after changes constitutes acceptance of the updated Terms.
